Mayor Alan C. Stauffer called the regular meeting of the Afton Town Council to order at 4:00 p.m. and welcomed all of those in attendance. Mayor Stauffer led those present in the pledge of allegiance.
Those present included Mayor Alan Stauffer, Councilman Sam Hepworth, Councilman Van Hale, Councilman David Parsons, Councilman Hal Titensor, Town Administrator/ Attorney Jim Sanderson, Town Clerk Lisa Hokanson, Civic Center Coordinator Justin Visser, Police Chief Tim Heggenstaller, Golf Course Maintenance Darin Neuenschwander, Director of Public Works Blake Robinson, Town Mechanic Quinn Sessions, Town Treasurer Heather Warren, Afton Fire Chief Alan Sessions, Afton Planning and Zoning Chairman Loni Hillyard, and Afton Planning and Zoning Board Member David Dory. Mayor Stauffer called for the review of the minutes from the regular Afton Town Council Meeting held May 12, 2009. No changes were noted. Mayor Stauffer also called for the review of the consent agenda, business licenses, and building permits issued. At the call of the Mayor, Councilman Hale made a motion to approve the minutes, the consent agenda, business licenses, and building permits issued. Councilman Parsons seconded the motion. Motion carried. Mayor Stauffer called for the review of the bills against the Town of Afton for the period ending May 31, 2009. Discussion was held regarding an invoice submitted by Plan One Architects in the amount of $1,335.90 for services rendered pertaining to the Afton Civic Center. At the call of the Mayor, Councilman Titensor made a motion to withhold payment to Plan One Architects in the amount of $1,335.90 until further review. Councilman Hale seconded the motion. Motion carried. At the call of the Mayor, Councilman Hepworth made a motion to approve the remaining bills against the Town of Afton as presented, seconded by Councilman Parsons. Motion carried.

Mayor Stauffer presented the bids received for the purchasing of a used dump truck for the public works department. Mayor Stauffer presented a bid received from Grover’s All Wheels, LLC in the amount of $51,475.00. A bid was received from Lake City Trucks in the amount of $65,238.00. After some discussion, Councilman Hale made a motion to authorize Mr. Jim Sanderson to discuss financing options with the apparent low bidder, Grover’s All Wheels, LLC and report back to the Council with the findings. Councilman Hepworth seconded the motion. Motion carried.
Mrs. Connie Jenkins, Project Director of Star Valley Senior Citizens, Inc., informed the Council that their funding from the State, Federal, and County has been reduced for the upcoming year. Mrs. Jenkins asked that the Council consider donating $10,000.00 to the center in the upcoming fiscal year budget. The Council expressed appreciation to Mrs. Jenkins for the services that their organization provides. The Council informed Mrs. Jenkins that they will review this matter further before a determination is made.
Mr. Jim Sanderson presented a proposal submitted by Jones Simkins P.C. pertaining to the Town audit. It was determined that the Town will continue to have Jones Simkins P.C. conduct the Town’s audits.
Discussion was held regarding a change order payable to Peavler’s Mountain Star, Inc. in the amount of $38,500.00, which was originally determined to be paid to Peavler’s by the previous Town Council. At the call of the Mayor, Councilman Hale made a motion to pay Peavler’s Mountain Star $38,500.00 as previously agreed upon. Councilman Hepworth seconded the motion. Councilman Parsons and Councilman Titensor voted nay due to the fact that they were not serving as part of the Council when the original decision was made. Mayor Stauffer voted in favor the motion. Motion carried.
Mayor Stauffer presented an application for payment submitted on behalf of Johnson Excavation for services rendered pertaining to Schedule B of the Afton Water Project, which includes the installation of water meters in the amount of $84,747.73. At the call of the Mayor, Councilman Hepworth made a motion to approve payment to Johnson Excavation in the amount of $84,747.73 as presented. Councilman Hale seconded the motion. Motion carried.
Mayor Stauffer presented Resolution 2009-10, a resolution pertaining to the operating and income expenses of the water and sewer enterprises of the Town of Afton. It was determined that the water fund has received funds from the general fund for the current fiscal year in the amount of $74,705.00. At the call of the Mayor, Councilman Hepworth made a motion to pass Resolution 2009-10 as presented, seconded by Councilman Parsons. Motion carried.
Mayor Stauffer presented the renewal applications for the retail liquor licenses submitted by Star Valley Outlaw Saloon, LLC, Argaya, LLC, Shelly’s Cowboy Bar, LLC, Colter’s Lodge, Inc., Maverik, Inc., and the restaurant liquor licenses submitted by Homestead Restaurant, Inc., Los Cabos, Inc., and Agave Mexican Restaurant. Mrs. Lisa Hokanson, Town Clerk, informed the Council that the Wyoming Liquor License Division had reviewed the applications and the proper advertising had taken place. Police Chief, Tim Heggenstaller, advised that he had received no objections to the proposed renewals. At the call of the Mayor, Councilman Parsons made a motion to approve the five retail liquor licenses and the three restaurant liquor licenses as presented, seconded by Councilman Titensor. Motion carried.
Ms. Ira Tijerina discussed with the Council the possibility of holding a community market throughout the summer months. Discussion of locating the event next to the Afton Civic Center was held. It was determined that this would allow for adequate parking. Ms. Tijerina stated that the event will be in compliance with the proper licensing and also the health inspections that are required. At the call of the Mayor, Councilman Hale made a motion to allow the community market to be held throughout the summer months on the property located next to the civic center with the condition that all proper licensing and health inspections are in place. Councilman Parsons seconded the motion. Motion carried.
Mr. Jon Abrams, Lincoln County School District #2 Superintendent, discussed the First Avenue project with the Council. It was determined that the Town is responsible to complete all of First Avenue including the portion which is located next to the new Afton Elementary School. Mr. Kevin Kilroy stated that he was contracted by the school district to do the work on the upper portion of First Avenue and Madison Street, which runs adjacent to the new elementary school. Mr. Kilroy advised that the lower portion of First Avenue would be excavated and a gravel road would be in place until the road was completed. The Council discussed the condition of the lower portion of First Avenue, which includes from approximately 260 E. First Avenue to Adams Street. Mr. Blake Robinson advised that plans were currently underway to begin advertising for bids for the overlay project for Second Avenue to begin this summer. After some discussion, Councilman Parsons made a motion to remove the Second Avenue project off of the capital improvement project list for the 2009/2010 fiscal year budget and to replace the project with overlaying the upper portion of First Avenue as per the agreement with the Lincoln County School District and also include overlaying the lower portion of First Avenue to complete the road. Councilman Hepworth seconded the motion. Motion carried.
Mr. Justin Visser, Civic Center Coordinator, updated the Council on the recent events that have been held at the center. Mr. Visser advised that an Afton Tourism Board Meeting was recently held. Mr. Visser stated that the Board voted to renew the ads with Sno-West and the Wyoming Travelers Journal. The Board voted nay to giving money to the Star Valley Jaycees for the annual car show due to the fact that they have other projects that they are currently considering donating funds to.
Mr. Visser advised that the Star Valley Chamber of Commerce has moved their office into the civic center. Mr. Visser is working with the Chamber to schedule events for Afton. The Council thanked Mr. Visser for his efforts on behalf of the Town.
Mayor Stauffer opened the budget amendment hearing at 5:00 p.m. Mayor Stauffer advised that the purpose of the budget amendment hearing was to make the necessary amendments to the Town of Afton’s 2008/09 fiscal year budget. Mr. Jim Sanderson presented the proposed changes to the budget. Mayor Stauffer opened the hearing to receive input and public comments pertaining to the proposed budget amendments. No comments were made. The public hearing closed at 5:05 p.m. At the call of the Mayor, Councilman Parsons made a motion to pass Resolution 2009-11, a resolution amending the fiscal year 2008/09 budget for the Town of Afton. Councilman Hepworth seconded the motion. Motion carried.

A RESOLUTION AMENDING THE FISCAL YEAR 2008/2009 BUDGET FOR THE TOWN OF AFTON, WYOMING.
WHEREAS, pursuant to Wyoming Statute §16-4-111, on the 10th day of June, 2008, the Governing Body of the Town of Afton, Wyoming passed, by ordinance the Fiscal Year 2008/2009 General Fund Budget for the Town of Afton, Wyoming, and;
WHEREAS, changes in the amount of revenue and expenditures from the General Fund have occurred, and:

Mr. Alan Sessions, Afton Fire Chief, updated the Council on the calls that the fire department had responded to throughout the month. Chief Sessions advised that the fire department had recently elected new officers, which will begin their duties on July 1, 2009. Elected as officers include Afton Fire Chief Rodd Hillyard, Assistant Fire Chief Rory Coates, and appointed as Fire Department Secretary is Rick Sessions. Outgoing officers include Afton Fire Chief Alan Sessions, Assistant Fire Chief Rodd Hillyard, and Fire Department Secretary Dennis McDonald. At the call of the Mayor, Councilman Titensor made a motion to approve the elected new officers for the Afton Volunteer Fire Department as presented, seconded by Councilman Parsons. Motion carried. After further discussion, Councilman Hepworth made a motion to amend the motion and thank the outgoing officers for their services on behalf of the Town of Afton, seconded by Councilman Hale. Motion carried. Chief Sessions thanked the Council and Town personnel for their help and support.
Mr. Tim Heggenstaller, Afton Police Chief, updated the Council on the calls that the police department had responded to throughout the month. Chief Heggenstaller also updated the Council on the training that their department has recently attended.
Mr. Jim Sanderson informed the Council that the Afton Adult Softball Leagues are currently underway.
Mr. Sanderson advised that the Afton Golf Board has been holding weekly meetings to discuss issues and concerns pertaining to the construction at the golf course. Mr. Mark Weston, Afton Golf Board Chairman, discussed the progress at the golf course and the payment application request submitted by Peavler’s Mountain Star in the amount of $34,460.05. Mr. Weston suggested that a walk through at the golf course be completed with the architects and approval from the architect be given before payment is made. At the call of the Mayor, Councilman Hepworth made a motion to approve the application for payment submitted by Peavler’s Mountain Star in the amount of $34,460.05 contingent upon approval from Mr. Fred Bliss, Golf Course Architect. Councilman Hale seconded the motion. Motion carried.
Councilman Parsons advised the Council that the Bank of Star Valley has offered to donate a mobile home trailer to be used as a pro shop until a clubhouse can be built at the course in the future. The Town would be required to move the building to the golf course. It was determined that Mr. Sanderson will contact the Bank of Star Valley to pursue this matter further. The Council thanked the Bank of Star Valley for this generous donation.
Councilman Titensor presented the minutes from the Afton/ Lincoln County Airport Board Meeting held April 23, 2009.
Mr. Jim Sanderson presented the minutes from the Afton Utility Board Meeting held on June 8, 2009. Mr. Sanderson reported that the water meter installation project is underway and is going well.
Mr. Sanderson informed the Council that Mr. Lance Mortensen, who currently owns a hanger at the airport, is planning to install approximately 200′ of sewer line to his property. Mr. Mortensen inquired about the possibility of being reimbursed for the installation of the sewer line from future users or possibly receiving a reduced connection fee. Mr. Sanderson stated that the Board advised Mr. Mortensen that he could not receive a reduced connection fee but a developer installed improvement ordinance was in place. Mr. Mortensen was instructed to complete the necessary paperwork to receive reimbursement from future users.
At the call of the Mayor, Councilman Hepworth made a motion to take a short break at 5:55 p.m., seconded by Councilman Parsons. Motion carried.
The regular meeting of the Afton Town Council reconvened at 6:05 p.m.
Mayor Stauffer dismissed Councilman Hale from the meeting at this time due to other commitments.
Mrs. Loni Hillyard, Afton Planning and Zoning Board Chairman, presented a final plat approval request submitted from Miles Beverage, Inc., Condominium Development, within Lot 7 of South Afton Third Addition to the Townsite of Afton in Section 36, T32N R119W and Section 31, T32N R118W, in Lincoln County, Wyoming. The development will be located south of Sixth Avenue and east of Washington Street and includes the Miles Beverage building. The existing building will be divided into three separate condominium units. The Planning and Zoning Board and the Afton Utility Board had approved the preliminary plat with the condition that the utility and emergency vehicle access easement identical with the common elements as shown is granted to the corresponding entities, and that all water and sewer infrastructure is private and will be the responsibility of the condominium association. The building must also be in compliance with the State of Wyoming fire codes. Mr. Marlowe Scherbel, representing Miles Beverage, Inc., stated that the building will meet the fire and IBC codes and will be classified as limited condominium units. At the call of the Mayor, Councilman Hepworth made a motion to accept the recommendation of the Planning and Zoning Board and approve the final plat for Miles Beverage, Inc. with the conditions as stated. Councilman Titensor seconded the motion. Motion carried.
Mrs. Loni Hillyard presented a request for a final plat approval submitted by Mr. and Mrs. Farish Thompson. The property is described as the Estates at Valli Vu Second Filing- Lot 31 of the Estates at Valli- Vu within Section 6, T31N R118W, in Lincoln County, Wyoming. Mr. Thompson had previously requested a variance to meet setback requirements. The Planning and Zoning Board denied the request and asked that a boundary adjustment be worked out with the Town. The property exchange between the Town and the petitioners would be of equal value. It was determined that the boundary adjustment would not have a significant impact on the surrounding lot owners and would allow the lot owner sufficient space to build a home that would be in compliance with the setback requirements. Mrs. Hillyard advised the Council that the Planning and Zoning Board approved the final plat with the condition that payment for all fees and costs associated with the petition, survey, and preparation of the legal description be paid by the petitioner, the petitioner execute the quit claim deeds required that would transfer a portion of their platted lot to the Town, and authority be given to the Mayor to sign the final plat contingent upon the petitioners delivery of the executed deed. At the call of the Mayor, Councilman Parsons made a motion to accept the recommendation of the Planning and Zoning Board and approve the final plat for Mr. and Mrs. Farish Thompson with the conditions as stated. Councilman Hepworth seconded the motion. Motion carried.
Mrs. Hillyard presented the land use chart to be used in conjunction with Title 17, Land Development Code. Mrs. Hillyard advised the Council that the Planning and Zoning Board had reviewed the chart and recommended approval of the land use chart as presented. At the call of the Mayor, Councilman Hepworth made a motion to approve the land use chart as presented, seconded by Councilman Titensor. Motion carried.
Mayor Stauffer presented Ordinance 594 for third and final reading, an ordinance of the Town of Afton, Wyoming, for the annual appropriation for fiscal year July 1, 2009, through June 30, 2010. At the call of the Mayor, Councilman Parsons made a motion to place Ordinance 594 on third and final reading, seconded by Councilman Hepworth. Motion carried. After some discussion, Councilman Hepworth made a motion to amend the golf course expenditure budget from $191,490.00 to $255,263.00. Councilman Titensor seconded the motion. Motion carried. Councilman Titensor made a motion to give the permanent full time employees that do not take the Town’s insurance an additional $100.00 per month, seconded by Councilman Hepworth. Motion carried. Councilman Hepworth made a motion to amend the community development budget from $31,000.00 to $33,000.00. No second to the motion was made. Motion failed. After some discussion, Councilman Parsons made a motion to pass Ordinance 594 with the amendments as stated, seconded by Councilman Hepworth. Motion carried.

AN ORDINANCE OF THE TOWN OF AFTON, WYOMING FOR THE ANNUAL APPROPRIATION FOR FISCAL YEAR JULY 1, 2009 THROUGH JUNE 30, 2010, PURSUANT TO WYOMING STATUTE §16-4-104
WHEREAS, on the 14th Day of April, 2009, the Department Administrators and Mayor of the Town of Afton submitted to the Town Council a proposed Town Budget for the 2009/2010 fiscal year, beginning the 1st day of July, 2009, and ending the 30th day of June, 2010; and
WHEREAS, the Governing Body has reviewed the budget and discussed the proposed budget with the Department Administrators; and
WHEREAS, a copy thereof has been made available for public inspection at the office of the Clerk of the Town of Afton; and
WHEREAS, notice of a public hearing, as required by Wyoming State Statue, on said budget, will be held on June 9, 2009, at 5:00 p.m. at the Afton Town Hall, and a summary of said budget will be published in the Star Valley Independent, a legal newspaper, of general circulation in the Town of Afton, after third and final reading; and
WHEREAS, a public hearing was held on such Budget at the time and place specified in said notice, at which time all interested parties were given an opportunity to be heard.
NOW, THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE TOWN OF AFTON, WYOMING THAT:
Section 1: The Afton Town Budget as hereafter presented by adopted as the official Town Budget for the fiscal year beginning the 1st day of July, 2009 and ending the 30th day of June, 2010.

Mr. Jim Sanderson updated the Council on the legal issues pertaining to the Greater Yellowstone Coalition and Simplot. Mr. Sanderson stated that a hearing will be held in August, 2009, pertaining to this matter. Mr. Sanderson will keep the Council updated as this matter proceeds.
Mayor Stauffer covered the following correspondence:
A letter to the Economic Development Administration from the City of Kemmerer, Wyoming, regarding a notification pertaining to their withdrawal from the Lincoln-Uinta Association of Governments.
A memorandum from the Local Government Liability Pool regarding excess liability coverage.
A letter from Governor Dave Freudenthal regarding funding for the Community Juvenile Service Boards throughout Wyoming.
A letter to Mr. Ramon Warren from the Town of Afton regarding a notice of code violations and a compliance request.
A letter to Peavlers Mountain Star, Inc. from the Town of Afton regarding services rendered at the Valli Vu Golf Course.
A notice from the Lincoln County Office of Planning and Development regarding a conditional use permit application for a proposed RV Campground Resort submitted by Mr. Earl Peavler.
A letter from the Office of State Lands and Investments regarding direct revenue distributions.
A letter from the Local Government Liability Pool regarding a notification pertaining to the retirement of the current executive director and the appointment of the new executive director.
Discussion of the Lincoln- Uinta Association of Governments was held. Mayor Stauffer informed the Council that there are assets remaining in the fund that will be divided between the participating entities. Mayor Stauffer will keep the Council updated as this matter proceeds.
At the call of the Mayor, Councilman Parsons made a motion to go into executive session at 7:25 p.m., seconded by Councilman Titensor. Motion carried.
The regular meeting of the Afton Town Council reconvened at 7:40 p.m. Land issues and legal issues were discussed with no action taken.
Discussion of the public hearing to be held on June 16, 2009, at 5:00 p.m. at the Afton Town Hall was held. The purpose of the hearing will be to accept public input and comments pertaining to the Town of Afton applying for a grant to pay for the costs of construction of handicap accessible restrooms to be located at the Valli Vu Golf Course. The public is invited to attend.

MINUTES FROM THE SPECIAL AFTON TOWN COUNCIL MEETING
PUBLIC HEARING FOR A GRANT APPLICATION
JUNE 16, 2009
5:00 P.M.
AFTON TOWN HALL
Mayor Alan C. Stauffer called the Special Afton Town Council Meeting to order at 5:00 p.m. and welcomed all of those in attendance. Mayor Stauffer led those present in the pledge of allegiance.
Those present included Mayor Alan Stauffer, Councilman Sam Hepworth, Councilman Hal Titensor, and Councilman David Parsons, with Councilman Van Hale being excused from the meeting due to other commitments. Others present included Town Administrator/ Attorney Jim Sanderson, Town Clerk Lisa Hokanson, Golf Course Maintenance Darin Neuenschwander, Civic Center Coordinator Justin Visser, Afton Golf Board Chairman Mark Weston, Afton Golf Board Member Bill Hoopes, and Mike Petersen.
Mayor Stauffer opened the public hearing at 5:00 p.m. Mayor Stauffer stated that the purpose of the public hearing is to receive input and accept public comments pertaining to the Town of Afton applying for a grant to pay for the costs of construction of handicap accessible restrooms to be located at the Valli Vu Golf Course. The total amount of the grant application will be $65,000.00.
Mr. Jim Sanderson advised that the proper advertising had taken place for the hearing and notices were posted throughout Afton as well.
Mr. Darin Neuenschwander, Golf Course Maintenance, presented an overview of the project. Mr. Neuenschwander advised that the restrooms would be located midway through the course with cart paths leading to the restroom. Mr. Neuenschwander also stated that the restrooms would be ADA compliant. The building will include restrooms with a utility closet located in the center of the building. The Town will be applying for a Community Block Development Grant with the Town matching the funds with labor, the donation of the land, and the required excavation work for the project.
Mr. Bill Hoopes stated that he was in favor of the project. Mr. Hoopes advised that the handicap accessible restrooms would be an asset to the course specifically for individuals with disabilities.
No further comments were received from the public. Mayor Stauffer closed the public hearing at 5:05 p.m. and noted that no unfavorable comments were received.
Mayor Stauffer presented Resolution 2009-12, a resolution authorizing submission of an application to the Community Development Block Grant for ADA (handicap accessible) restrooms to be located at the Valli Vu Golf Course in Afton, Wyoming. At the call of the Mayor, Councilman Hepworth made a motion to pass Resolution 2009-12 as presented, seconded by Councilman Titensor. Motion carried.
At the call of the Mayor, Councilman Parsons made a motion to adjourn the special Afton Town Council Meeting, seconded by Councilman Titensor. Motion carried. The meeting adjourned at 5:10 p.m.
The next regular meeting of the Afton Town Council will be held on Tuesday, July 14, 2009, at 4:00 p.m. at the Afton Town Hall.

Located in beautiful Star Valley, Afton has a population of 1,821 and sits at 6239 feet above sea level.
Native Americans and Fur Trappers first inhabited Star Valley. The Valley soon became a stop for Mormon settlers looking for better opportunities for their families.
The Mormon settlers called the Valley Starvation Valley due to the long harsh winters. During the winter months they lost many cattle and many went hungry. Later they shortened the name to Star Valley.
Afton is centrally located in Star Valley at the mouth of Swift Creek Canyon. It was the rumbling of Swift Creek that helped Afton get its name. William Budge a Scotland Native visited the township and as he walked the banks of Swift Creek he was reminded of a stream from his homeland. Budge suggested the Town be named Afton after the Sweet Afton Fame stream of Scotland.
Afton was incorporated in 1902 and A.V. Call was elected as the first mayor.
